What is a Property Maintenance Plan?

A Property Maintenance Plan provides Body Corporate members, owners and prospective owners with a means of anticipating the cost of upcoming maintenance, repairs and associated capital expenditure. This allows the Body Corporate to ensure the annual levies raised will fund future maintenance expenses.

Legal Requirement for Maintenance Plans

On 31 March 2010, the Unit Titles Act 2010 (“the Act”) was passed into law replacing the Unit Titles Act 1972. The Act is the primary legislation relating to the creation and management of multi-unit developments.

The Unit Titles Act requires Body Corporates to have a 10-year maintenance plan that identifies the future maintenance requirements and estimates the costs involved. It also requires the following funds be established:-

      A.      Operating Fund (Compulsory)

      B.      Long-Term Maintenance Fund (Compulsory)

      C.      Contingency Fund (Optional)

      D.     Capital Improvement Fund (Optional)

Why have a Property Maintenance Plan?

The main reason for a Property Maintenance Plan is that it is the most cost-effective way to maintain the value of an asset.

The advantages of a maintenance plan are:     

      •        It will help maintain the value of Unit Title owners’ investments

      •        It allows you as a property owner to budget appropriately

      •        It sets maintenance priorities and opportunities for deferring costs appropriately

      •        It ensures maintenance is undertaken in a methodical, planned way

      •        It reduces large unexpected costs 

      •        It helps a Body Corporate meet its legal and fiduciary obligations

When buildings are neglected, defects can occur which may result in extensive and avoidable damage to the building fabric, structure or equipment. 

Maintenance is critical for all buildings but especially so for plastered buildings constructed prior to 1994 when cavity cladding construction was introduced. There is no redundancy built into non-cavity plaster cladding systems and a proper maintenance program is an absolute necessity to keeping moisture out of the cladding system.
